PAY, OVERTIME AND BENEFITS
Under the Federal Fair Labor Standards Act, ERISA and various Pennsylvania Labor laws, all employees are entitled to be paid for the work they do. This includes your entitlement to benefits. Your employer is required by law to pay you time and a half for any overtime. Now, in Pennsylvania, the minimum wage is $7.25 per hour, and no unauthorized deductions can be taken from your pay. Just because you sign a document or “contract” saying you are independent contractor does not necessarily mean you are an independent contractor, and you may still be covered by Federal and State laws protecting employees and workers.
